The website, BMF and mobile application for android and iOS (Mobile App) (“The Website” or “Site” and Mobile App) is an electronic web based platform which facilitates and acts like an online purchase manager for all the needs of construction materials/ products and services. (“Services”) It minimises your purchase hassles and helps you save time, energy and costs. It is owned and managed by BMF India.

Any and all use of this website is subject to, and constitutes acknowledgment and acceptance of, the following terms and conditions ("Terms"/ "Terms of Use") and privacy policy ("Policy"). It is mandatory for all users of the Site to have read carefully, fully understood and be in total agreement to the below mentioned Terms before they proceed to use any of the Services of the Website. The Services are available only to those individuals, firms or companies who can form legally binding contracts under the Indian laws. For the purpose of these Terms, wherever the context so requires "You" or "Your" or "User" shall mean any natural or legal person who has agreed to access the website to avail the Services of BMF.com and "We" or "Us" or “Our” “It” shall mean the website BMF.com. BMF Private limited may amend these Terms of Use at any time by posting the amended version on this site. Such amended version shall automatically be effective upon its posting on this site. By using BMF/ Mobile App, you acknowledge and enter into agreement to our Terms and Policy set out below and you agree that you will be bound by the Terms contained in this agreement ("User Agreement") BMF/ Mobile App will act with integrity towards its customers and make best endeavors to procure materials from a reliable source; BMF.com is not a stockist of materials and relies on supplies from other sources.

Selling

As a registered seller, you are allowed to list item(s) for sale on the Website in accordance with the Policies which are incorporated by way of reference in this Terms of Use. You must be legally able to sell the item(s) you list for sale on our Website. You must ensure that the listed items do not infringe upon the intellectual property, trade secret or other proprietary rights or rights of publicity or privacy rights of third parties. Listings may only include text descriptions, graphics and pictures that describe your item for sale. All listed items must be listed in an appropriate category on the Website. All listed items must be kept in stock for successful fulfilment of sales. The listing description of the item must not be misleading and must describe actual condition of the product. If the item description does not match the actual condition of the item, you agree to refund any amounts that you may have received from the Buyer. You agree not to list a single product in multiple quantities across various categories on the Website. BMF reserves the right to delete such multiple listings of the same product listed by you in various categories.

I. Definitions

Users for the purposes of this Agreement means and includes a "User" is any person who accesses the Site or the Mobile App for whatever purpose, regardless of whether said User has registered with BMF as a registered User/ Member or whether said User is a paying customer for a specific service provided by BMF.com (“Buyer”) or is a manufacturer or a stockist of materials offering products/ services on our Website or Mobile App for Buyers (‘ “Seller”). A User means only those individuals, firms or companies who can form legally binding contracts under the Indian laws. Content for the purposes of this Agreement means and includes not being limited to web-pages, hyper-links, tools, information, software, text, graphics, links, video etc. Free Services means services availed by any User who joins this web portal of BMF or the Mobile App either to list his/her/its requirements, creates wish list or just with the intention to enlist his/her/its listing and showcasing availability of stocks, materials, products, services etc. Paid Services for the purpose of this Agreement: access to this web portal BMF or Mobile App and certain features are provided to all Users free of charge.

However, we reserve the right, without prior notice, to restrict access to certain areas or features of the Website or Mobile App ("Paid Services") to paying Users or Users who undergo a specific registration process. Access to and use of these Paid Services may be governed by additional terms and conditions under separate agreements in addition to this Agreement. The Company reserves a right, without prior notice to you, to make Services provided by it subject to payment for use.

Registered User/ Member Includes a Buyer and a Seller. Third Party Content for the purpose of this Agreement means certain Content displayed on this Website or Mobile App, provided or posted by third parties.

II. Application and Acceptance:

The following are the terms of the Agreement between You and BMF.com. By accessing, or using this Web site or Mobile App, you acknowledge that you have read, understood and agree to be bound by these Terms and Privacy Policy and to comply with all applicable laws and regulations, including but not limited to export and re-export control laws and regulations if any applicable to you. If you do not agree to these terms, please do not use this Website.

We may without notice to You, at any time revise these Terms of Use and any other information contained on this Website and Mobile App The Company may also make improvements or changes in the Services or programs described in this Website and Mobile App at any time without notice; you agree that these amended Terms will apply to you. You may not use the Services and may not accept the Terms if, You are not of legal age to form a binding contract with BMF.com as use of the Website and Mobile App is available only to persons who can form legally binding contracts under applicable Indian laws for this purpose. Persons/Users who are "incompetent to contract" within the meaning of applicable Indian Laws or any other applicable law for this purpose including minors, un-discharged insolvents etc. are not eligible to use the Website. You shall not offer, sell, purchase or bid for any products/ services offered on the Website or Mobile App if you are not eligible to be bound by legal contracts; or You are not permitted to receive any Services under the laws of India or other countries / regions including the country / region in which you are resident or from which you use the Services.

You may be required to enter into a separate agreement, whether online or offline, with BMF.com or our affiliate for any Service ("Additional Agreements"). If there is any conflict or inconsistency between the Terms and an Additional Agreement, the Additional Agreement shall take precedence over the Terms only in relation to that Service concerned. If BMF.com has posted or provided a translation of the English language version of the Terms, you agree that the translation is provided for convenience only and that the English language version will govern your uses of the Services or the Site. Your use of our Website or Mobile App and all the web-pages, hyper-links, tools and services provided there under (which shall include successor or replacement website/mobile application) is governed by the following Terms as applicable to the Website/Mobile App ( ”User Agreement” ). This User Agreement shall come into effect upon your each visit or usage of the Website/Mobile App, upon you providing any information or upon your registration on the Website/Mobile App In this User Agreement, you are contracting with BMF.com.

We reserve the right to limit, deny or create different access to the Website/ Mobile App and its features with respect to different Users, or to change any of the features or introduce new features without prior notice.

III. Provision of Services:

This Website/ Mobile App is an electronic web based platform that facilitates an online purchase manager for all the needs of construction materials/ products and services. It should be noted that BMF/ Mobile App is merely a market place platform for connecting Buyers and Sellers.

Please note the applicability of the following if you are a "Buyer" : You may be required to register on Our Website portal/ Mobile App as a Buyer to access our Services and help us serve your requirements

Our failure, delay or omission to exercise or enforce any rights or provisions of these terms and conditions will not constitute a waiver of such rights or provisions. A waiver on any one occasion will not be construed as a bar or waiver of any rights or remedies on future occasions. Any claim in relation to Services or Terms should be filed within 3 (Three) months from when the cause of action arose. Any claims filed beyond this time period shall be barred.
